On June 21, 2023, 140 past employees of Houston Methodist Hospital System terminated for refusing Covid vaccination filed an amended complaint in the US District Court, Southern District of Texas, CIVIL ACTION 4:23-cv-1699.

The 126 page complaint is attached here. Overview of the complaint includes:

  • U.S. Supreme Court noted since the beginning of the pandemic: “even in a pandemic, the Constitution cannot be put away and forgotten.” Roman Catholic Diocese of Brooklyn v. Cuomo, 141 S.Ct. 63, 208 L.Ed.2d 206 (2020)
  • Congress (early 1980’s) established “the Common Rule” (45 CFR 46), explicit in that no individual can be under “coercion,” “undue influence,” “unjustifiable pressure,” or a “sanction” to participate in the use of medical products classified by the FDA as experimental. (45 CFR § 46.116, the Belmont Report)
  • Congress enacted 21 U.S.C. §360bbb-3 (Authorization for Medical Products for Use in Emergencies), “required conditions” consisting of two rights of the people and, respectively, two duties upon the government.
  • August 2020, the Centers for Disease Control (CDC) Dr. Amanda Cohn stated, “Under an Emergency Use Authorization, an EUA, vaccines are not allowed to be mandatory.
  • 2021, individuals nationwide, exercising a federally secured right to refuse investigational medical products, were subjected to unconstitutional treatment by authorities disagreeing with their chosen option, subjected to severe human rights abuses violating ratified treaties, federal laws, and the laws of all US States and Territories…
  • April 2021, Houston Methodist, the Board of Directors, Robert A. Phillips, MD, PhD, and CEO Marc L. Boom, as Houston Methodists policymaker, decided that the suffering of the few was justified by the windfall such suffering had on Houston Methodist’s financial bottom line.

And that was just the beginning of a national nightmare that affected hundreds of thousands of healthcare workers, airline pilots and military personnel across this nation… we pray ‘a reckoning’ is coming for all those terminated and forced out of the workforce, those that accepted the vaccines to keep their families fed and off the streets, the vaccine injured and our beloved military now serving under the fascists at the Biden DOD.
